Mollah’s death warrant illegal: Khandker Mahbub Hossain (video)

RTNN, Dhaka: The warrant issued for executing Jamaat-e-Islami leader Abdul Quader Molla’s death sentence is illegal, his lawyer Khandker Mahbub Hossain said today (Monday).

Addressing a press conference, Khandker Mahbub Hossain, also BNP Chairperson Khaleda Zia’s Adviser and Vice Chairman of the Bar Council, said the tribunal has no authority to issue the death warrant since it had not passed Mollah’s death sentence.

He said that only the Supreme Court, which pronounced the verdict, could send the death warrant to the jail authorities.

“The prison authorities cannot execute the death sentence on the basis of the warrant sent by the tribunal. If they do it, they will remain fully liable for that,” he said, hoping the government would protect the dignity of the rule of law.

Commenting on death sentence awarded to the Jamaat leader, the Appellate Division has sentenced him to death despite the lower court jailing him for life, following appeal by the government. I do not know if there is any such instance in the sub-continent,” Hossain observed.

The International Crimes Tribunal on Sunday issued the warrant hours after receiving a copy of the full version of the Supreme Court verdict sentencing Mollah to death.

The International Crimes Tribunal on February 5 sentenced Mollah to life for his war crimes and the highest court on October 17 revised the life term to death sentence.

“It is rare to sentence someone on the basis of statement of a witness. If judgment is prepared on that basis witness has to be like an angel,” said Hossain.

Urging the government not to be in a hurry, he said: “Let him (Mollah) have his verdict reviewed. Let the countrymen see that his death penalty has been executed after fulfilling his all facilities.”
