Death penalty based on fake witness: Mollah's family (video)

09 December,2013

RTNN, Dhaka: During a press briefing at SC Bar Association auditorium today, Mollah’s family has demanded a ‘proper retrial’ of the war crimes case against him after investigation through a neutral probe agency.

Jamaat leader Abdul Quader Molla’s son Hasan Jamil said, “We have come to know that the government is rushing his (Quader Molla) execution out of political motivation. He wasn’t even allowed to appeal which is a violation of Jail Code and human rights.”

“This is the first time in history the Supreme Court has overturned a life sentence awarded by the presiding court in favour of a death penalty. It is his constitutional right to be able to appeal for a review. Considering one of the judges were against the death penalty, it is even more important to allow review,” Jamil read out from a written statement.

He also claimed that the witness Momena Begum, whose testimony played the key role in condemning him was not even a real witness. The prosecution produced a false witness.

“The woman who gave testimony through camera trial in the tribunal was not real Momena Begum. A woman was falsely presented as Momena to give witness before the tribunal. The original picture of Momena was found in Liberation war museum,” said Hasan Jamil.

“The forgery has been unfolded after getting the original image of Momena Begum,” he added.

He said lawyers confirmed that the woman identified as Momena Begum in the picture of Liberation War Museum and the woman produced before the tribunal, are completely different ones.
